Burlein, the commission chairman, was appointed lie the agency in 1963. His 10-year term has ended, but grounds' refused to leave on that Cerillli's appointment by Gov. Shapp was illegal. Burlein says he can serve until a legal sucnamed. Cerillli, a former union offiheaded the Westmoreland County district of the state Transportation Department prior to his appointment last Dec.
31. In arguments scheduled Monday, court was to hear a Republican challenge to 680 appointments made by Shapp without Senate confirmation. Cerilli's appointment was one of them. Three Republican senators charge Shapp's action was illegal because only the Senate was adjourned when the appointments were made. T.
Newell Wood, Richard C. Frame and Richard A. Tilghman contend both houses must quit for the year before a governor can bypass the two-thirds Senate confirmation vote. The Senate is controlled by Democrats, the House by Republicans-who refused to adjourn in an effort to block the appointments. Shapp ignored the GOP tartic and made the appointments anyway.
Named were members of the Labor Relations Board, Milk Marketing Board, Liquor Control Board, state licensing boards, trustees of state hospitals, state college trustees and county boards of assistance, among others. Shapp bypassed the confirmation process because he's been unable to muster the two-thirds majority. The Democratic Senate margin is 25-23. Other governors have used the same tactic: appoint officials for interim one-year terms and if they're not conifrmed duirng the year, reappoint them after final of Many are serving at least their second interim term. Normally, different positions carry reguiar terms of varying lengths.
On Dec. 29, two days before Shapp acted, the Supreme Court upheld 864 appointments made by the governor following the 1971 adjournment. In that, instance, both houses had year. In their brief, attorneys for Wood, Frame and Tilghman argue: "There is no question the Senate attempted to adjourn sine die finally on Dec. 31, 1973, and that it attempted to do so without requesting or receiving consent of the House or Representatives.
Plaintiffs contend that the Senate was without power to take this action without the consent of the House of Representatives." Atty. Gen. Israel Packel and the governor's counsel, Lawrence Beaser, counter in their brief: "The constitution makes no reference to a need for approval, concurrence or joint action by the House of Representatives. Nor is there any reference to sine die adjournment of the 'General Assembly." Rather, only 'recess of the Senate' is mentioned. Frank J.

Carol Marie was a seventh grade student at LakeLehman High School and a member of Independent Bible Church, Her mother is the former Florence Gorski of Nantico*ke. The girl was admitted to Mercy, 26, 1973, Hospital, serious Scranton, on condition and received expensive medical care, including cobalt treatments. Her family has been plagued by hardship the past few years with two of the Harris children in ill health and Mr.
Harris having lost his right eye in a truck accident several years ago. A fund drive has been set for the Harris family at United Penn Bank, Dallas. WILLIAM PEARLMAN Dr. William Pearlman, 64, of 71 died W. Sunday River morning Wilkesshort- ly after being admitted to Mercy Hospital. Born at Rutherford, N. he was a graduate of Cornell University and taught at New York University.
He later studied at St. Andrew's School of Medicine, Scotland, and interned at Wilkes-Barre Mercy Hospital 41 years ago. He then opened his private practice in Wilkes- Barre. He also did post graduate work at Polyclinic Hospital, New York City. He was a member of various medical associations and a past president of the Luzerne County Medical Society and served as a delegate to Harrisburg for the society.
Dr. Pearlman was a past president of the Mercy Hospital Medical Staff and specialized in diabetic diseases. Deceased was a veteran of World War II, serving as an Air Force Flight Surgeon, and was discharged with the rank of captain. He was a past commander of the Jewish War Veterans, a former board member of Luzerne County Community College Barre president of the Wilkes City School Board. Dr.
Pearlman was a former director of the Jewish Community Center and was the JCC Camp Board since its inception. He was also a past finance chairman of the WilkesBarre Republican Party. He was a member of Temple Israel and Ohav Zedek Congregation. Kingston, was pronounced dead on arrival Saturday night at Nesbitt Memorial Hospital, victim of an apparent heart attack. Born in Plymouth, he moved to Kingston as a young man former owner Sunshine Beverage Company, Kingston, and until retiring last year was operator of the Dallas, Mosfedleski was a member of St. Ignatius Church, Kingston. He was an avid golfer and won a number of area, course championships and trophy awarded in his name for the senior top golfer in the annual Dan Donnelly Memorial Tournament. Surviving are his widow.
